Any capitalised term used in this privacy policy (Privacy Policy) but not defined shall have the same meaning as provided under the Solis Health Benefit Plans Terms and Conditions (Solis Health Benefit Plan T&Cs).

Solis Health Private Limited, a company incorporated under the laws of India, having its registered office at #58, 15th Crossroad, JP Nagar 2nd Phase, Bengaluru, Karnataka – 560078 (Company) has launched “Health Benefit Plan” – an annual paid subscription service (Subscription) open to individuals and families (Members). The Subscription includes (a) facilitation of teleconsultation; (b) preferred rates for in-person treatment; (c) preferential rates to access to the Compay’s wellness centers; (d) concierge services to help navigate through the in-person treatment; and (e) other complimenting services provided by the Company at its discretion (Services), as detailed in the Health Benefit Plan Circle T&Cs.

References to Member in this Privacy Policy to also include a reference to their dependents, to the extent applicable, unless it is specified or indicated otherwise.

What is this privacy policy?

This Privacy Policy describes the manner in which the Company collects, uses, processees, stores, transfers and discloses the information provided by its Members in relation to Care Circle or any individuals (Users) that visit the Company’s website, portal, or any other platform (Platform). All Members and Users shall be bound by this Privacy Policy and the Company shall not use any information supplied by Members or Users, except in accordance with this Privacy Policy.

By clicking on ‘I/We Accept’ during the sign-up process on the Platform Members and Users agree to and accept the terms and conditions provided for under this Privacy Policy, read in addition to the Solis Health Benefit Plan T&Cs available at [insert link]. In the event Members avail of the Subscription or Services on behalf of a dependent who is not a User, Members shall ensure that the relevant individual is informed of the terms of this Privacy Policy and their consent is obtained for the purposes mentioned herein. Members’ use of the Services, Members’/Users’ visit to the Platform and any dispute over privacy are subject to this Privacy Policy and the Solis Health Benefit Plan T&Cs.

As part of availing of the Services offered by the Company, Members may enter into arrangements with Service Providers (defined below). The personal information collected and processed by the Service Providers pursuant to such arrangements will be governed by such Service Providers’ privacy policies and practices

What information does the Company collect?

The Company will only collect information that is necessary for the purposes of rendering the Services. Set out below is a list of information collected from Members or Users (collectively referred to as Collected Information).

Information provided by Members/Users

The Company may collect Personal Information (PI) such as name, address and contact details from its Users and Members as well as collect Sensitive Personal Information (SPI) such as payment details, medical records and history, and physical, physiological and mental health conditions from its Members in the course of subscribing to Health Benefit Plan or availing the Services.

[Members may also choose to provide their Aadhaar information for the purposes of identification and creation of a repository of Members to ensure there is no duplication of Subscription membership in accordance with applicable law. By providing their Aadhaar information and accepting this Privacy Policy the Members consent to the Company collecting their Aadhaar details for such purpose. The provision of Aadhaar information is purely voluntary and the Members may alternatively provide other identification documents such as PAN Card, Passport, Driving License, etc.]

Who has access to the Collected Information?

Employees, Authorised Personnel, and Affiliates

All information that is collected, stored, processed or disclosed to the Company is accessible only to authorised personnel and employees of the Company and the Service Providers on a need-to-know basis. All employees and data processors, who have access to and are associated with the processing of Collected Information are obliged to respect its confidentiality. The Company and the Service Providers may also disclose Collected Information to its affiliates for business purposes, such as for the promotion, sales or marketing of such affiliates services.

Service Providers

In order to effectively offer the Services to Members, the Company may be required to transfer Collected Information in relation to the Members to third party administrators, healthcare providers, telehealth providers, platform service providers, client services providers, call center providers and technology partners (Service Providers) such as Izaap Technologies Private Limited, Trivio Technologies, Apollo Health Resources Benefit, Medi Assit, Altruist Technologies, as well as entities such as its affiliates, and acquiring, investing or purchasing parties. During such transfer, the Company will ensure that the recipient entity adheres to the same level of security standards as used by the Company, and also commensurate with applicable data protection laws.

Government Institutions or Authorities

The Company and/or the Service Providers may be required to disclose Collected Information to governmental institutions or authorities under any law or judicial decree. The Company and/or the Service Providers may disclose Collected Information in their sole discretion, in case the Company and/or the Service Providers deem it necessary in order to protect their rights or the rights of others, to prevent harm to persons or property, to fight fraud and credit risk, or to enforce or apply this Privacy Policy or the Solis Health Benefit Plan T&Cs or any other policies by the Company. The Company shall not be responsible for the manner or method in which such institutions and authorities use or disclose such Collected Information.

How does the Company protect Collected Information?

The Company has implemented security policies, rules and technical measures, as required under applicable law to protect the Collected Information from unauthorised access, improper use or disclosure, unauthorised modification and unlawful destruction or accidental loss. While the Company is committed to maintaining confidentiality of all Collected Information, it shall not be responsible for any breach of security or for any action of any third parties that receives Collected Information due to events that are beyond the reasonable control of the Company including, acts of government, computer hacking, unauthorised access to the Company’s computers and storage devices, computer crashes, breach of security and encryption, etc.

What rights do Members/Users have?

Right to Review : Members/Users can access their Collected Information at any time to review the same.
Right to Rectify : Members/Users can seek to rectify any inaccurate or deficient Collected Information, and the Company may rectify it if feasible.

Right to Withdraw Consent : Members may withdraw their consent for the collection, use and/or disclosure of SPI in the Company’s possession or control, by submitting a request to operations@solis.health. The Company will process the Member’s request within a reasonable time from when the request was made, and thereafter not collect, use and/or disclose said SPI as per their request. Depending on the extent of the withdrawal of consent for the Company to process Collected Information, it may mean that said Member will not be able to further use or access the Company’s Services.

Changes to this Privacy Policy

The Company reserves the right to modify this Privacy Policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the Platform. If the Company makes any changes to this Privacy Policy, the Company will notify Members/Users that the Privacy Policy has been updated, so that they are aware of what information is collected by the Company, how it is used, and under what circumstances, if any, can the Company use and/or disclose it. In case the Company makes any changes to this Privacy Policy in relation to the processing of SPI collected from its Members, the Company will obtain consent from the Members for further processing of SPI following changes (if any).
